Terms of Use

An AI-powered marketing and sales CRM: lead management, sales pipeline, sales team, conversations, AI Setter, email marketing, automations, forms, calendar, tasks and reports, depending on your plan.

Features marked "Coming soon" are not part of the plan until they are available.

You must be at least 18 years old and provide accurate information. You are responsible for your credentials, the activity in your account and the team members you give access to. Let us know right away if you suspect unauthorized access.

The Service is billed as a monthly subscription per business through Stripe. The subscription renews automatically each month until you cancel.

If your plan includes a free trial, the chosen plan is charged when it ends unless you cancel before.

Prices exclude applicable taxes. If we change your plan's price we will notify you at least 30 days in advance.

Unless the law requires otherwise, payments are non-refundable and we don't refund partial periods.

You can cancel at any time from your business's billing page; you keep access until the end of the paid period.

We may suspend or close an account for non-payment, for breaching these terms or if its use puts the Service or others at risk. Where reasonable, we will notify you first.

After cancellation you can export your data; we will delete it as described in the Privacy Policy.

The data you load into the CRM is yours. You grant us a limited license to host, process and display it only to provide the Service.

You are responsible for having the legal basis and consents required to process your leads' and customers' data and to contact them (by email, messages, SMS or calls).

You may not use the Service to send spam or unsolicited messages; you must comply with applicable laws, including the TCPA, CAN-SPAM, A2P 10DLC registration rules and the policies of Meta, WhatsApp, Google and any other service you connect.

You also may not upload illegal or misleading content or content that infringes third-party rights, try to access other businesses' data, reverse engineer, overload or attack the Service, or resell it without our written permission.

AI features may produce inaccurate or incomplete results. Review what they generate before using it.

The AI Setter replies to your leads on your behalf according to how you configure it: you are responsible for its configuration, for supervising it and for what your business communicates.

Jen AI only sends emails or creates events in your connected accounts after you confirm.

The Service integrates with third-party services (for example, Meta, Google, Stripe, Twilio or ManyChat). Their use is governed by their own terms and we are not responsible for their changes, outages or decisions about your accounts.

Marketing services that Elevate Hub Agency LLC provides as an agency (content, ads, social media management and similar) are contracted separately and governed by their own agreement; they are not part of the CRM plans.

The Service, its software, design, brand and content belong to Elevate Hub Agency LLC or its licensors. We only grant you a limited, non-exclusive, non-transferable right to use it while your subscription is active. If you send us suggestions, we may use them without obligation to you.

We work to keep the Service available and secure, but there may be interruptions for maintenance or reasons beyond our control. We may improve, change or remove features; if we remove a major feature of your plan we will give you reasonable notice.

The Service is provided "as is" and "as available". To the extent permitted by law, we make no warranties of merchantability, fitness for a particular purpose or business results (for example, number of leads or sales).

To the extent permitted by law, Elevate Hub Agency LLC will not be liable for indirect, incidental, special or consequential damages, or for loss of profits, data or business. Our total liability for any claim related to the Service will not exceed what you paid for it in the 12 months before the claim.

You agree to defend and indemnify Elevate Hub Agency LLC against third-party claims arising from your use of the Service, the data or content you load, or your breach of these terms or the law (for example, messages sent without consent).

These terms are governed by the laws of the State of Florida (United States). Any dispute will be resolved in the competent courts of Florida, unless the law grants you a different venue.

We may update these terms. If the change is material we will notify you by email or in the CRM before it takes effect; if you keep using the Service afterwards, you accept them.
